The court filings also claim that the children’s parents have a questionable history, “Alleging “documents or allegations that the parents of the two boys have a history of fraudulent and scamming behavior,” said KOAT legal expert John Day.The attorneys further claim that Busfield passed a polygraph test and was cleared by a medical expert in child abuse sex cases. However, prosecutors argue that Busfield has a history of multiple alleged incidents, although he was never charged.”There were prior allegations against Butterfield about 30 years ago and in other situations that should lead the judge to keep him in custody,” said KOAT legal expert John Day.A judge will determine if Busfield will be released from jail while awaiting trial. In New Mexico, the presumption is that the defendant should be released on conditions of release unless the prosecutors can change the judge’s mind.
