The Constitution says Congress, not the President, has the power to declare war on another nation, but there are exceptions and disagreements about war power. Let’s get the facts. *** declaration of war requires *** majority vote in both the House and the Senate, but the Constitution also says the president is the commander in chief of our military forces. That means the president has authority to use the military in situations deemed necessary. For national security, technically we never declared war for the military conflicts in Korea or Vietnam or what are known as the wars in Afghanistan and Iraq, but we often use the term war to describe these events because of the massive casualties and the full scale military mobilizations. So while Article 1 of the Constitution indicates *** president can’t unilaterally declare war, Article Two does allow the president to use military. Action during *** national emergency or attack and that’s backed by the Supreme Court. President George W. Bush had that power after 9/11, but Congress did officially sign an authorization for military force against those who attacked the US.
